Terms and Conditions – Dawaii Application
Introduction
These Terms and Conditions constitute a legally binding agreement between you and Dawaii Company regarding your use of the Dawaii application and its electronic services. This agreement is governed by the applicable laws of the State of Kuwait and the user's country of residence.
Definitions
- "Dawaii": The digital platform owned and operated by Dawaii Company.
- "User": Includes patients, healthcare practitioners, healthcare institutions, visitors, or any party using the platform.
- "Service": Any healthcare, technical, or interactive services provided through the Dawaii application.
- "Provider": Any medical or professional entity (individual or institution) offering healthcare services through Dawaii, including doctors, hospitals, laboratories, pharmacies, and dental clinics.
Acceptance of Terms
By using the application, you acknowledge and agree to be bound by these Terms and Conditions. If you do not agree, you must refrain from using the application.
Legal Capacity
The user must be at least 18 years old or have legal authorization from a guardian or competent authority to use the application.
Privacy and Confidentiality
Dawaii is committed to protecting privacy in accordance with the Kuwaiti Data Protection Law and the Gulf Data Protection Regulation. Medical and personal data are collected and stored securely and are only shared with authorized parties in compliance with applicable laws.
Use of Service
The platform may not be used for any unlawful purpose or in violation of healthcare regulations in Kuwait or Gulf countries, including providing misleading information or impersonation.
Responsibilities of Patients
- Provide accurate and complete information when registering or requesting any service.
- Adhere to booked appointments and notify the doctor or institution in advance if canceling.
Responsibilities of Practitioners and Institutions
- Provide licensed healthcare services in accordance with the requirements of the Kuwaiti Ministry of Health and relevant Gulf authorities.
- Respect patient data confidentiality and refrain from misuse.
- Update medical and professional information on the platform regularly.
Special Conditions for Service Providers (Hospitals – Laboratories – Pharmacies – Dental Clinics)
1. Licensing and Accreditation
- The entity must be officially licensed and valid by the Ministry of Health or the competent regulatory authority in the country of residence.
- The entity must renew its license and enable the platform to verify its validity upon request.
2. Quality of Service
- Adherence to applicable medical and professional standards.
- Provide accurate, safe, and reliable services while respecting patient rights and data confidentiality.
3. Information and Transparency
- Update institutional data (address, working hours, available services, prices) regularly.
- Refrain from providing misleading or scientifically unverified information.
4. Advertising and Promotions
- It is prohibited to publish any advertisement or promotional offer that violates medical regulations or professional ethics.
- Dawaii management reserves the right to review or reject any advertising content.
5. Liability
- The entity is responsible for any professional error or legal violation resulting from its services.
- The platform is not responsible for the outcomes of tests, prescriptions, or medical procedures provided by the provider.
6. Account Suspension or Termination
- Dawaii management has the right to suspend or terminate any provider's account in case of proven violations of the terms or credible complaints.
Licensing and Compliance
All healthcare practitioners, health centers, pharmacies, laboratories, hospitals, and dental clinics registered on the platform must hold valid official licenses and comply with all applicable regulations and professional standards. Registered entities are responsible for providing proof of licensing, renewing it, and enabling the platform to verify its validity upon request.
Intellectual Property
All intellectual property rights of the application and digital content are reserved to Dawaii Company. Copying or using any part of the application for commercial purposes without prior written consent is prohibited.
Special Provisions for Subscription Packages and Advertising – Medical Service Providers on Dawaii
Notice: These provisions form an integral part of the Service Providers' Terms of Use (doctors – hospitals – dentists – pharmacies – laboratories). In case of conflict between these provisions and the general terms above regarding subscription and advertising matters, these special provisions shall prevail within their scope.
Introduction
These provisions regulate the use of subscription packages and advertising services offered by Dawaii for medical service providers.
Definitions
- "Package": The commercial or advertising plan offered by Dawaii in return for a specified subscription fee.
- "Advertising Services": All forms of digital promotion within the application, including paid ads, featured listings, and promotion via email or notifications.
- "Fees": The financial amounts due from the provider for subscribing to packages or advertising services.
- "Provider": Any medical or professional entity (individual or institution) offering healthcare services through Dawaii.
Pricing and Changes
- Dawaii reserves the full right to change or amend subscription and advertising package prices from time to time in accordance with its policies and business considerations.
- Providers will be notified in advance of any material changes in prices or related terms before the start of the next billing cycle.
- The new price shall take effect from the next subscription cycle or advertising campaign following the notification date, and continued use of the services shall be deemed implicit acceptance of the amended prices.
Amendments
Dawaii reserves the right to amend these Terms and Conditions at any time. Users will be notified of amendments via the application or email.
Disclaimer
Dawaii bears no responsibility for damages resulting from misuse of the service or reliance on electronic diagnosis without consulting an actual physician.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait. The courts of Kuwait shall have exclusive jurisdiction over any dispute arising from this agreement.
